Sobre este particular, el juez de Luxemburgo, con su ejemplar asunto Jana Petruchová refuerza la  perspectiva proteccionista en tanto que, la sumisión a favor de los tribunales de la compañía inversora será nula, como consecuencia de la formidable  interpretación teleológica del inversionista al ser considerado consumidor.
