不同领域及宏观文本参数下汉西法律术语的概念性变体

法律语言植根于通用语言,语言中普遍存在一词多义现象导致法律语言被打上模棱两可、晦涩难懂和含糊不清的烙印。由于具体法律领域和语境的差异,源语言中的同一概念可能在译文中衍生出不同含义和用法。本研究基于交际术语理论框架,聚焦汉译西法律文本中的术语概念性变体,通过分析“活术语”和 “语境术语”,观察译者术语翻译的用词选择过程。在翻译中华人民共和国不同领域法律文本的基础上构建语料库,通过各种情境因素和宏观文本参数,检测和分析因模棱两可或含糊不清而产生的问题术语,以便译者甄选术语。
